PokerStars Eligable for US Liscense

 

The US government currently restrict the use of online real money gambling organisations within the country. This is due to the events of April last year, which many within the poker community have dubbed ‘Black Friday’.

The US Department of Justice bought various civil charges against different online poker brands and banned the operation of real money gambling websites. One organisation that faced legal action from the DOJ was Full Tilt Poker. The company was accused of using deceptive billing codes which prevented gambling transactions from being processed, as well as money laundering and bank fraud. Eventually Full Tilt owed more money than they could repay without having to sell their assets.

PokerStars purchased the Full Tilt Poker brand as part of an agreement with the US Department of Justice. They agreed to forfeit a total of $731 million in compensation to Full Tilt’s former customers. Claims from players within the US are dealt with by the US government and are repaid using the funds from PokerStars, a total of $547 million. The other $184 million was used to reimburse those from outside of the United States.

PokerStars now plan to re-launch the Full Tilt website in November and operate it from the Dublin offices where it was previously run by the Pocket King Company, saving hundreds of jobs.

PokerStars have expressed a keen interest to reintroduce their brand back into the US market, should legislation and regulatory actions allow it. They are hoping to reinstate the company at both a state and federal level. However, this is dependent on whether the US government legalise the online real money gambling industry and allow online poker organisations to return to the American market. Discussions between Harry Reid, the Democratic US Senate Majority leader and Republican Senatorial anti-gambling leader, Jon Kyl are on-going.

Should the online poker industry be legalised in the US, PokerStars and Full Tilt have been informed by the Department of Justice that, as part of their agreement, they will be eligible to apply for licensure. Eric Hollreiser, the Head of Corporate Communications at PokerStars is hopeful that PokerStars will make a return to US soil in the future, saying:

“We look forward to this opportunity and are confident that we bring tremendous value, regulatory experience, market credibility and financial integrity to the US marketplace.”

Some US states have already legalised the online poker industry to their intrastate markets. Nevada is already launching online versions of real money casino games and Delaware is not far behind, looking to issue licensing by early 2013. However, launching the PokerStars website exclusively in these locations pose technical issues and legal implications for the organisation. PokerStar’s are awaiting an overall decision from the US government.
